Presidential reference against Justice Qazi Faez Isa quashed by Supreme Court
ISLAMABAD: The Supreme Court, in its short judgment, has removed the presidential reference against Justice Qazi Faez Isa.
The Supreme Court, in its short judgment delivered at 4 pm, granted the petition of Justice Qazi Faez Isa seeking cancellation of the reference.
The decision to quash the reference against Justice Faiz Issa was unanimously taken by all 10 judges.
Seven judges ordered that the tax cases of Qazi Faiz’s wife be referred to the Federal Board of Revenue (FBR), while a judge, Justice Yahya Afridi, dismissed Qazi Faez Isa’s plea against the reference.
A 10-member larger bench of the Supreme Court today also heard the petition of Justice Qazi Faiz Issa in which Federal Counsel Forough Naseem submitted the FBR documents in a sealed envelope.
According to reports, the TAX record of Justice Qazi’s wife was also submitted to the court by the FBR.
Justice Umar Ata Bandial, who presided over the bench on Forough Naseem’s record, said, “We are not reviewing the envelope yet, and we will not pass any order on it.” We are now listening to the petitioner’s lawyer Munir Malik.
Meanwhile, Justice Qazi Faez’s lawyer Munir A Malik also presented the documents in a sealed envelope.
Besides, the wife of Justice Qazi Faiz Issa also submitted copies of agricultural land and passport.
In his counter-arguments, Munir A. Malik said that in the Iftikhar Chaudhry case, there were allegations of malice against the Supreme Judicial Council. Farogh Naseem said that his original case was not the one in reference. According to election and NAB laws, husband and wife are responsible for their assets.
He said that instead of the government going to the FBR, they have come to the Supreme Judicial Council. Let the FBR do its job. We have never obstructed it. Justice Qazi Faez Isa challenged the reference for the honor of himself and the judiciary. Judge Faiz annulled the reference against Isa.
Munir A. Malik said that there is a difference between the orders and show cause notices of the Supreme Judicial Council, and the Supreme Judicial Council cannot review the conduct and malice of the President, the job of the council is only to determine the facts.
